    The Bill 10 Threat

    In June 2025, the Ontario government passed Bill 10 “The Protect Ontario Through Safer Streets and Stronger Communities Act”, rushed through without consultation. Sounds good at first glance, but the wording poses a major legal risk to Ontario housing providers. If Regulation 8 of the bill is implemented in its worst form, you could be held legally responsible for criminal drug activity committed by your tenants.

    Yes, you heard that right. Legally responsible for the criminal activities of others. You could be expected to monitor and report your tenants’ behaviour, or risk fines, arrest, prosecution, and property seizure.

    As housing providers, we already strive to keep drug dealers out of our rentals. But, we don’t have the legal tools, authority, or ability to closely monitor tenants, obtain information from police, and quickly evict. Privacy rules, the Residential Tenancies Act, procedural hurtles and a dysfunctional Landlord & Tenant Board are major obstacles. These are all GOVERNMENT-imposed obstacles. Now the government proposes to criminalize us for not being able to overcome them.

    Regulation 8 poses a threat not only to innocent landlords, corporate officers, boards of directors, non-profits, but it’s also bad for tenants. It may increase costs for housing providers which means higher rents, and more people could be denied housing out of fear. Worse still, it could exacerbate the existing rental housing shortage as current landlords flee the industry and new potential landlords are scared off.

    At a time when we are in a housing crisis, and we need more landlords providing more housing, this sort of thing is counterproductive. On one hand, governments at all levels are asking us to provide more housing, but on the other hand, they keep piling on more regulations, costs and obstacles. As always, it’s the smaller landlords who are the most vulnerable.

    So, what are we doing about this latest threat?

    The QRLA is rallying fellow regional landlord associations across Ontario to join forces and organize an advocacy effort. We aim to warn the government that Bill 10’s Regulation 8 could have serious unintended consequences. We support and are backing-up the advocacy efforts of the Federation of Rental Housing Providers of Ontario (FRPO).
